The purpose of the rules concerning parties’ right of access is to ensure the parties’ due process protection. It is a fundamental guarantee of due process protection that a party is made aware of the basis for a decision and that he or she is given an opportunity to comment on the matter. FV-03 describes in more detail the provisions set out in the Public Administration Act concerning the appellant’s right to access documents in his or her own immigration case and UNE’s independent duty to provide information. Topics that are dealt with in more detail include who has right of access, which documents constitute the ‘case documents’, exceptions to the right to access and enhanced access to information.
