In expulsion cases the health conditions of an appellant, and his or her situation upon return due to the health condtions, will be weighed against the severity of the crime committed.
In exceptional cases, the appellant's health conditions may be given greater weight in the assessment of whether the measure will be proportionate.
FV-07 describes the applicable regulations and UNE’s practice in such cases. The guide describes documentation requirements for health circumstances, how such cases are investigated, the requirement in UNE’s practice relating to the severity of the condition in question, and the requirement for the available treatment in the home country, among other things.
